Quote from: jclures on May 13, 2026, 01:04:31 PMI think they will declare themselves bankrupt and never pay a cent.Bankruptcy laws and the reasons for it are very complex they may still have to make all/some payments anyway , personally I think they are in a precarious situation because they ignored their notifications, ignored the court date, and broke their agreement with the claimant , all of which will go against them, and they probably know this by now.
Being a court order it's no good hiding, the sheriffs will be looking at every single item they own and in whose name it's in in their home state untill it's paid. Quote from: Fizzie on May 12, 2026, 07:18:26 AMWas about to mention that!
The moral of this story is Be very careful what you say (especially if you're out to get Youtube likes!)![]()
(Although they've probably already made that money back by now by posting the story there & getting even more hits!)
Quote from: Rowlie on May 11, 2026, 07:53:29 PMThere are a few things in the video that don't quite add up.
"Hit whilst parked" claims often attract a degree of scepticism from insurers. My guess is that the repairer / assessor has suggested the damage is inconsistent with the circumstances as described on the lodged claim and they have decided to reject the claim. The customer is entitled to an explanation of the basis for the rejection. They are possibly holding the excess pending an expected escalation.
Based on the video details it is a matter that should be referred to AFCA (the ombudsman). Costs nothing for the customer but the insurer has to pay significantly whether they win or lose. They can also be hit with punitive costs for things like customer inconvenience etc. The outcome is binding on the insurer but the customer still retains legal rights ie court.
