Title: Takata airbags class actions – Notice of Proposed Settlement Scam or not?
Post by: Raym on October 19, 2021, 01:41:55 PM
Received an email today from a no reply address with the message below. The links were live.

I do have a Nissan that had airbags replaced.

How did they get my email address? Maybe from contact details for air bag replacement that I provided the dealer.

Is this legit or scam. Not game to click on links.

 "Dear Madam/Sir

This email contains important information that may affect your legal rights. Please read it carefully and consider your options.

You are receiving this email because you have been identified as a person who may be a group member in class action proceedings filed in the Supreme Court of New South Wales against Toyota, Lexus, Subaru, Honda, BMW, Nissan and Mazda brought on behalf of consumers affected by Takata airbag recalls (Takata airbags class actions).

An in-principle agreement to settle the Takata airbags class actions has been reached between the parties (proposed settlement). The total agreed settlement sum is $52 million, inclusive of all legal costs, costs of settlement administration and any funder's remuneration. Eligible group members will be entitled to receive a settlement payment if the proposed settlement is approved by the Court.

Access to the Notice of Proposed Settlement is available here: www.airbagclassaction.com

It includes information about:

how to register to receive a settlement payment from the settlement; and

I just got the same e-mail from previously having the Forester, which had the passenger's front bag changed.

I'm wondering what the claim is for?

Those (very ???) few people who were injured when bags went off ??? & I think there was 1 fatality in Oz ???

Compensation for the time & effort you had to go to to have a free replacement installed ???

Anybody have any ideas ???

Had a quick read of some of the stuff but doesn't say amounts. There was a sum of 53m mentioned & legal fees of 13.5m but not sure if anything is guaranteed as yet.

Also not sure if it gets chucked out who gets to pay legal costs.

Had a quick look as well.  It's waiting on the Court to rubber stamp it.  They will usually only knock it back if there is something wrong or grossly unfair for the complainant.
After the legal costs are taken out $40m gets distributed to the rest, about 3 million vehicles affect, so if everyone puts you their hand, then $15 each.
You then wive tour right to sue, or you can try to sue on your own.
